Tenant Background Report Errors: What You Should Know

As a consumer, you have the right to expect the products you purchase will meet certain standards of quality and reliability. When a product fails to live up to these promises, you may be entitled to compensation under California’s breach of warranty laws. 

Looking for a place to live can be stressful. It gets even worse when something wrong shows up on your background check. Landlords, property managers, and even employers often rely on background reports to make decisions. If those reports are wrong and it costs you a home or a job, you don’t have to just live with it. You have rights, and you can take action.

You Have Rights Under the Law

By law, companies that prepare background reports must try to make sure the information is correct. But mistakes happen. Sometimes reports show the wrong person’s record, include outdated court cases, or leave out important facts. These errors can be serious. They can lead to your rental application getting denied or even make you lose out on a job.

Correcting Mistakes in Your Report

If something in a background check harms you, the first step is to request a copy of your report. You have the right to see what it says and to check that everything is accurate. If there’s a mistake, you can send a dispute to the company that made the report. They are required to look into the issue, usually within 30 days.

But what if you dispute the problem and the company doesn’t fix it? If the wrong information is left in your report and causes you harm, you may be able to take legal action. The company that gave the wrong information and the company that put the report together could both be held responsible. You might be owed money for the damage the report caused—like lost rent, lost income, or emotional distress. They may also have to pay your lawyer fees and other costs.
